All services provided by Awebsolutions Limited may only be used for lawful purposes. The client agrees to indemnify and hold harmless Awebsolutions Limited from any claims resulting from the use of our services. Awebsolutions Limited provides an all-round top-quality service. The terms and conditions which follow are necessary to ensure that we may continue to provide the best possible service to all our clients whilst at the same time fulfilling our legal and ethical responsibilities.
Failure to follow any term or conditions will be grounds for immediate account deactivation without notice. Awebsolutions Limited will be the sole arbiter as to what constitutes a violation of any of these provisions. Activity which results in the suspension or deactivation of an account will result in a forfeiture of all fees paid. Complaints made regarding abuses of an account will be investigated and if found guilty will be grounds for immediate suspension.
The client agrees that Awebsolutions Limited may, in its sole and absolute discretion, modify this Agreement and the Services it offers to its clients from time to time and that such modifications are effective immediately upon posting to its website. The client use of the site or Services, after such changes or modifications have been made, constitutes to the client agreement to be bound by this Agreement as last revised. If the clients have purchased Services from Awebsolutions Limited, the terms and conditions of this Agreement shall continue in full force and effect, including any changes made to this Agreement, as long as clients use the Services.
Although we try to maintain a very high service availability, the services provided by Awebsolutions Limited are not designed for mission critical use and should not be used for such purposes unless there is a written confirmation from us.

10. Client Responsibility
1. Cancellation, Termination & Refund Policy
1.1 Clients can cancel and terminate their account any time by a request through ticket system or e-mail to email@example.com. Request must come from e-mail ID provided in client account with us. Refund will be provided only in a case-to-case basis. No refund will be provided in case of below mentioned service categories purchase and once the money back guarantee time has passed. Client can continue to use those services till the current subscription term ends.

1.2 Non-paid services will be terminated once they expire. No data or backups will be retained or provided after a service is terminated. In case of data or backup is required by client, it should be requested prior to service expiry through support ticket or e-mail to firstname.lastname@example.org.
1.3 We reserve the right to cancel and/or withdraw any Service provided at any time for any reason by providing you 30 days notice sent by email, but can use these services until the current subscription term ends.
2. Domain Name Agreement
2.1 The Client must ensure that he or she is the registrant of each Domain Order must agree to be bound by the terms and conditions laid out by the Registrar of the Domain Name during the term of the Domain Order and does not register the domain on someone else behalf. The Client acknowledges that registration of a Domain is subject to third party terms and conditions including those from the relevant registry for the Domain extension. The Client must familiarize with such terms and confirms that it will always and, in all respects, comply with ICANN’s, Nominet and any relevant registry’s terms and conditions for domain registration and use.
2.2 The Client acknowledges that the Registrar has various rights and powers as mentioned in the Registrar's terms and conditions. Awebsolutions Limited is not liable for any action taken by Registrar pursuant to the Registrar's terms and conditions. The Client acknowledges and agrees that the Client shall indemnify Awebsolutions Limited of and shall be responsible for any liability resulting from Registrants' noncompliance with such terms and conditions.
2.3 The Client will not make any changes to any information associated with the Domain Order without explicit authorisation from the Registrant of that Domain Order. The Client must comply with all applicable terms and conditions, standards, policies, procedures, and practices laid down by ICANN, Nominet or any other Registrars and the Registry Operators.

2.5 By registering or renewing a .uk top-level or second-level domain and agreeing to these terms & conditions, You agree that You have read and agree to the Nominet Terms & Conditions of Domain Name Registration. 2.6 Client agree to release, defend, indemnify and hold harmless Awebsolutions Limited, relevant registry service providers, PrivacyProtect.org, and their parent companies, subsidiaries, affiliates, shareholders, agents, directors, officers and employees, from and against any and all claims, demands, liabilities, losses, damages or costs, including reasonable attorney's fees, arising out of or related in any way to the Whois Privacy Protection services provided hereunder. In the event that the Client has not purchased the Whois Privacy Protection services, the Client must ensure that its details on the whois database are accurate and current failing which the Domain may be suspended by Awebsolutions Limited, ICANN or the relevant registry until such time as the Client can prove that the details on the whois database are accurate.
2.7 Awebsolutions Limited and relevant registry service providers, in their sole discretion, expressly reserve the right to freeze, delete, suspend, deny, cancel, modify, take ownership of or transfer any Domain Order, in order to comply with any applicable Dispute policies, requests of law enforcement, or in compliance with any Court Orders, or if Awebsolutions Limited or relevant registry in their sole discretion determine that the information associated with the Domain Order is inaccurate, or has been tampered with, or has been modified without authorization, or if Awebsolutions Limited or relevant registry in their sole discretion determine that the Domain Order ownership should belong to another entity, or if Client/Registrant does not comply with any applicable terms and conditions, standards, policies, procedures, and practices laid down by Awebsolutions Limited, , ICANN, Nominet and any relevant Registry Operator. The Client agrees that Awebsolutions Limited and relevant registry, and the contractors, employees, directors, officers, representatives, agents and affiliates, of Awebsolutions Limited and relevant registry, are not liable for loss or damages that may result from any of the above.
2.8 Awebsolutions Limited makes no representations, express of implied, that a particular Domain is available for registration and accepts no liability for failure to register a Domain for any reason also may from time to time change the registrar that a Domain is held with, at its discretion and without notice to the Client.
2.9 Awebsolutions Limited do not provide refund for registered domains paid by client. Awebsolutions Limited will take necessary steps to register domain names on behalf of the client when requested. However, clients are responsible for renewing their domain names. It is client's responsibility to provide us a working e-mail ID and phone number where we can send reminders and notifications. Client must verify and keep updated contact information to receive notifications and reminders in time. Awebsolutions Limited does not take responsibility for failing to renew domain names in any way. The client must check and take appropriate actions to renew a domain that is about to expire by making relevant payment before the expiry date using our control panel.
2.10 Free hosting with .UK Domain Name: - This offer is only valid for UK Domains (.UK, .CO.UK, .ORG.UK and .ME.UK) and the domain has to be registered or transferred and renewed with us -IP TAG: AWEBSOLUTIONS. Expried Domains or transfered away from us cannot use free services and all the data including emails, website and logs will de delated. To avial this offer must pay our standard price for UK domain registered or renewed currenty set at £9.99 per year excluding VAT or any other taxes and cannot be used in conjunction with any other offer, discount or promotions. If the UK domain transferred to us with more any 1 year of expiry date cannot use free hosting unless the domain is renewed.
3. Service Level Agreement (SLA)
We will respond under three business working hours to every email(email@example.com) or support ticket sent to us from your client control panel.
3.1 Hosting Services
3.1.1 "Uptime" refers to the amount of time the Services are available and "Downtime" refers to the amount of time the Services are unavailable, as measured solely and only by Awebsolutions Limited internal monitoring systems.
3.1.2 Awebsolutions Limited guarantees network uptime 99.95% on an annual base for all cPanel hosting packages, with the exception of scheduled maintenance operations including any DDOS attacks and emergency server restarts or hardware failure fixed under 1 hour.
3.1.3 In the event such level of service is not provided, we will provide free hosting as determined in the chart below. There will not be any refund for the following products and services: domain name registration, software licenses, IP address charges, set up fees, SSL certificate fees, and other services which are unrelated to uptime. Any claims should be done within 14 days of the incident of downtime by raising a support ticket and must include the dates and times of the downtime and the name and IP address of the server or servers which experienced the downtime.

95% or below will extend the same hosting package for 6 months for Free
3.2 SEO Services
3.2.1 100% refund if no ranking improvement within first 120 Days we will need a screenshot of Performance and link tab of the website from Google Search Console should be uploaded to client control panel and add us as a user before starting the seo process to qualify for refund.
3.2.2 Ranking improvement means showing better results in terms of ranking for more keywords, impressions and website having more links in first 120 days. Google Search Console should be active for all the 120 days and must provide Awebsolutions Limited access to us by adding us as a user to qualify for a refund.
4 Illegal Usage
4.1 Awebsolutions Limited servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots. The subscriber to a Awebsolutions Limited service agrees to indemnify and hold harmless Awebsolutions Limited from any claims resulting from the use of the service that damages the subscriber or any other party.
4.2 Awebsolutions Limited will be the sole arbiter as to what constitutes a violation of this provision.
5 Adult Content
5.1 Adult Content is not allowed including pornographic, obscene, unlawfully harassing, or connected with child abuse or sex-related merchandising.
6.1 Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
7 Chat Rooms And IRC
7.1 Awebsolutions Limited does not provide nor allow chat room's on shared hosting environments and does not allow IRC or IRC bots to be operated on our servers.
8 Background Running Programs
8.1 Awebsolutions Limited does not allow background Daemons such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with normal server operation.
9.1 Awebsolutions Limited will use good faith efforts to backup data stored on your Hosting account. We will not backup data on VPS or Servers accounts unless you order a Backup Service. We will not backup files holding temporary or transient data which cannot be restored in a useful state or corrupted backup files or software.
9.2 Awebsolutions Limited is NOT responsible for lost data, time, income, or any other resource due to faulty backups or non-existent backups. Please always backup your own data for fault tolerance and redundancy and you acknowledge and agree that it is your responsibility to regularly backup all your Content in order to prevent potential data loss.
10 Client Responsibility
10.1 Clients should always keep accurate contact information in their client account with us especially correct E-mail ID to contact you. Failure to keep correct contact information will result in non-receipt of communications from us. We may take appropriate actions regarding accounts with inaccurate contact information. The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. The client assumes responsibility for all material on their site that may be put on by a third party (such as the usage of Free for All links pages). The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of Awebsolutions Limited to provide this knowledge or support outside matter specific to Awebsolutions Limited servers. Awebsolutions Limited will not liable for any issues that may arise due to web site or web applications got hacked. Clients are responsible to implement proper security and occasional patching of their web application to keep the application securely hosted.
10.2 Awebsolutions Limited shall not provide legal advice referring to compliance of content and materials uploaded on or transmitted through our Services. You shall be solely responsible for verifying whether your content and materials comply with any applicable law, including laws in jurisdictions where your content and/or materials are uploaded, hosted, or accessed and shall not bear any liability if your use of the Services violates any law or regulation.
11 UCE (Unsolicited Commerce Email) - SPAM
11.1 Spamming, Mail Bombing or the sending of mass unsolicited email, from or through an Awebsolutions Limited server or using an email address that is maintained on an Awebsolutions Limited machine is STRICTLY prohibited. Email us to find the limits and guidelines of mail usage. Awebsolutions Limited will be the sole arbiter as to what constitutes a violation of this provision. If you engage in any of the foregoing activities using the service of another ISP or IPP, but channelling activities through an Awebsolutions Limited server as a maildrop for responses, you are in violation. Violators accounts will be terminated without notice.
12 Maintenance of Information
12.1 The information provided to Awebsolutions Limited is saved indefinitely and may be stored on one or more databases directly or indirectly maintained by Awebsolutions Limited. Awebsolutions Limited employs industry standard security measures to protect the confidentiality of the information.
12.2 While we cannot guarantee that loss, misuse or alteration to data will not occur; we make every effort to prevent such occurrences. Any other particularly sensitive information, such as credit card numbers collected for commercial transactions, is encrypted prior to transmission by you to Awebsolutions Limited.
13 Server Resource Usage Limitations
User May Not:
13.1 Use 25% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
13.2 Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
13.3 Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
13.4 Run any software that interfaces with an IRC (Internet Relay Chat) network.
13.5 Run any bit torrent application, tracker, or client. You may link to legal torrents off-site but may not host or store them on our shared servers.
13.6 Participate in any file-sharing/peer-to-peer activities
13.7 Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
13.8 Run cron entries with intervals of less than 15 minutes.
13.9 Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.
13.10 When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")
13.11 To help reduce usage, do not force html to handle server-side code (like php and shtml).
13.12 Have contact forms or login pages without any reqired security, please always use CAPTCHAs.
13.13 Upload, store, publish and display on or through our Service(s) any personal data, private or any other personally identifying information, images, videos of minors or any third party, without the consent of said party.
13.14 Store or upload backups or any other files, images, videos, zip folders etc that are not used to hosting website. We will remove any file more than 10MB zip/tr files and suspend your account if this violated.
14 Inode Usage & Limits
14.1 An inode is a data structure used to keep information about a file on your hosting account. The number of inodes indicates the number of files and folders you have. This includes everything on your account, emails, files, folders, anything you store on the server.
14.2 All Shared Hosting Accounts currently have a limit of 150k/250k inodes/file usage. All shared accounts only allow 150,000 inodes per cPanel account. This is a "soft limit," and when this limit is reached you will still be able to upload files. However, once the account passes the 150,000 inode threshold it will no longer be included in our daily backups. If the account exceeds 250,000 inodes then it will be in violation of our Acceptable Use Policy and may be flagged for review and/or suspension. Business Hosting packages have higher inode limit based on their package levels mentioned on the website when ordering the services.
Inode violations can include:
Creation and deletion of large numbers of files on a regular basis.
Using zip folders and using hosting space for storage.
Causing file system damage.
Exceeding 250,000 inodes.
14.3 Please note daily backups will be stopped for your account, if you reduce your inode limit to under 150k please inform us and will happy to start your daily backups and also please note if the inode limit is not under 250K your account will be suspended without any notice and terminated after 24 hours.
15 Multimedia Files
15.1 Multimedia files are defined as any graphics, audio, and video files. Awebsolutions Limited Web Hosting accounts are not to be used for the purposes of distributing and storing unusual amount of multimedia files. Any Web site whose disk space usage for storing the multimedia files exceed 70% of its total usage in limited shared hosting account and more than 2GB space in case of unlimited or large shared hosting accounts, either in terms of total size or number of files, will be deemed to be using unusual amount of multimedia files.
16 Actions Taken by Awebsolutions Limited
16.1 Failure by a client to meet or follow any of the above policies/terms is grounds for account deactivation. Awebsolutions Limited will be the sole arbiter as to what constitutes a violation of the Acceptable Usage Policy. Awebsolutions Limited reserves the right to remove any account without prior notice.
16.2 When Awebsolutions Limited becomes aware of an alleged violation of its Acceptable Usage Policy, Awebsolutions Limited will initiate an investigation. During the investigation, Awebsolutions Limited may restrict a client's access to prevent further potentially unauthorized activity. Depending on the severity of the violation, Awebsolutions Limited may, at its sole discretion, restrict, suspend, or terminate a client's web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, Awebsolutions Limited will notify the appropriate law enforcement authorities of such violation.
16.3 Awebsolutions Limited clients agree to indemnify and hold harmless Awebsolutions Limited from any claims resulting from the use of our services that damages them or any other party. The service provided by Awebsolutions Limited on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Awebsolutions Limited expressly disclaims any representation or warranty that the service provided by Awebsolutions Limited will be error-free, secure, or uninterrupted. No oral advice or written information given by Awebsolutions Limited, its employees, licensors, or the like, will create a warranty; nor may you rely on any such information or advice. Awebsolutions Limited and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
17.1 Awebsolutions Limited reserves the right to add, delete, or modify any provision of this Policy at any time without notice.
18 Refusal of Service
18.1 We reserve the right to refuse, cancel, or suspend service at our sole discretion within human reason. Services of any abusing clients will be terminated without any notice; no refunds or service credits will be provided for such termination of services.
19 Force Majeure
19.1 Neither party shall lose any rights hereunder or be liable to the other party for damages or losses on account of failure of performance by the defaulting party if the failure is occasioned by any occurrence or contingency beyond its reasonable control, including war, strike, fire, Act of God, earthquake, flood, lockout, embargo, governmental acts or orders or restrictions, failure of suppliers, or any other reason where failure to perform is beyond the reasonable control of the nonperforming party; provided that such party shall use commercially reasonable efforts to promptly mitigate any damages or losses.
20.1 Awebsolutions Limited is committed to providing the highest standard of customer service to all our clients. However, in the unlikely event of a problem or complaint, we will do everything possible to ensure it is dealt with quickly and fairly.
20.2 You can raise a complaint via the Contact Us page or from your client control panel raise a support ticket with a heading "Raise a Complaint", to enable us to deal with your complaint more effectively, please provide as much detail as possible.
20.3 You can raise a complaint in writing, to our registered office address at 85 Great Portland Street, First Floor, London, W1W 7LT. Please provide your account details along with the registered email id.
20.4 You should expect to receive a response to your query within two business days (twenty business days for postal complaints) of us receiving your correspondence.
20.5 Complaints Escalation 1: Incase your Complaint is not handled within two business days or you feel we have been unfair or unreasonable in addressing your concerns, you can ask for your complaint to be referred to our relevant Senior Manager for further review.
20.6 Complaints Escalation 2: If you are still not happy with the response you have received, you can ask for your complaint to be referred by the Awebsolutions Management or Director of the company, we will aim to give you a response within ten business days.
